Daniele Cervino is a Member in the firm's Environmental Law & Permitting practice. She represents clients in connection with a variety of environmental regulatory and transaction issues.
Daniele has represented private equity firms and developers in environmental due diligence and environmental aspects of transactions, risk mitigation and insurance coverage. She has counseled many companies on environmental compliance and cost recovery matters. She has served as Senior Vice President and General Counsel for Environmental Waste Management Associates (Parsippany, New Jersey), an environmental consulting and remediation firm and its related companies. She has negotiated dozens of insured fixed price remediation contracts and environmental insurance policies and associated claims. She was selected as one of New Jersey Real Estate Magazine’s “Women of Influence in Real Estate” in 2007.
Representative Matters
- Coordinated the recovery of environmental investigation and cleanup costs from major oil companies representing private property owners of gasoline service stations.
- Negotiated many pre-litigation settlements with certain insurance companies that issued policies between the 1970’s and 1986 for private clients for costs of defense, investigation and remediation of former manufacturing and industrial facilities and shopping centers in New Jersey.
- Provided strategic advice for Industrial Site Recovery Act (ISRA) and Site Remediation and Reform Act compliance and underground storage tank (UST) and permit compliance.
- Represented private clients before New Jersey Department of Environmental Protection and United States Environmental Protection Agency with respect to compliance with Notices of Violations, Administrative and Consent Orders for a variety of programs including land use and site remediation.
- Represented clients in state and federal “Superfund” sites including manufactured gas sites and river sediment sites including the Passaic River.
- Obtained public funding and cost reimbursement from New Jersey Hazardous Discharge Site Remediation Fund under its Innocent Party Grant, Petroleum Tank Fund and Redevelopment Agreement programs as well as New York’s Brownfields Cleanup Program.
- Regularly coordinated environmental due diligence and environmental insurance placement for several private equity funding investing in office, warehouses and retail centers.
- Negotiated environmental provisions of purchase and sale agreements for real estate and corporate transaction for commercial clients needing environmental expertise.
